Making a Planning Application – Reportable Political Donation or Gift Disclosure

Under section 147(4) of the Environmental Planning and Assessment Act 1979, a person who makes a relevant planning application (i.e. Development Application, rezoning planning proposal, development control plan or other application) to Council, is required to disclose any of the following reportable political donations and gifts (if any) made by any person with a financial interest in the application, within the period commencing 2 years before the application is made and ending when the application is determined:

  1. All reportable political donations made to any local councillor of Council.
  2. All gifts made to any local councillor or employee of Council.

Making a Public Submission – Reportable Political Donation or Gift Disclosure

Under section 147(5) of the Environmental Planning and Assessment Act 1979, a person who makes a public submission to Council in relation to a relevant planning application (ie Development Application, S96 application, rezoning planning proposal, development control plan) is required to disclose the following reportable political donations or gifts (if any) made by the person making the submission or any associate of that person, within the period commencing 2 years before the submission is made and ending when the application is determined:

  1. All reportable political donations made to any local councillor of Council.
  2. All gifts made to any local councillor or employee of Council.

Note: If Council receives a disclosure from any person who is legally required to provide a disclosure of any reportable political donation or gift under section 147 of the Environmental Planning and Assessment 1979, Council is legally required to disclose all relevant details of the reportable political donation or gift. This will include the name and address of the person or entity of who provided the political donation or gift onto Council’s reportable political donations and gifts register for full public viewing.
