Exhibition of the Draft Planning Agreement proposed by Stockland Development Pty Ltd for community input at Bong Bong Road, Horsley

Council at its meeting of 26 October 2010 resolved to exhibit the draft Planning Agreement proposed by Stockland Development Pty Ltd for community input.

Stockland Development Pty Ltd have requested that Council enter into a Planning Agreement for Stockland to provide payment of a monetary contribution ($30,000 per lot), the dedication of land and undertaking works within the road reserve as part of a subdivision proposal at Lot 60 DP 1063539 and Lot 601 DP 1054648 at Bong Bong Road, Horsley.

The Environmental Planning and Assessment Act 1979, enables development contributions to be made either through a Section 94 Development Contribution Plan, a Section 94A (percentage based) Development Contributions Plan or a Planning Agreement. A Planning Agreement is effectively a contract between a Developer and Council which specifies a monetary contribution, works to be undertaken or both, in lieu of the Section 94/94A plan applying to the land.

Stockland Development Pty Ltd has lodged Development Application No. 2010/693 for the subdivision of Lot 60 DP 1063539 and Lot 601 DP 1054648 Bong Bong Road (38.85 hectares) into 295 lots (including 27 “super lots” which are earmarked for further subdivision for multi-dwelling housing). This application is under assessment and will be referred to the Joint Regional Planning Panel for determination.

Stockland Development Pty Ltd have requested that Council enter into a Planning Agreement, as the West Dapto Section 94 Development Contribution Plan has not been finalised, and to allow the company to dedicate land to Council and undertake improvements to public infrastructure.

The draft Planning Agreement will enable Stockland Development Pty Ltd to proceed with their
development (subject to development consent) in advance of the finalisation of the West Dapto Section 94 Development Plan.

The draft Planning Agreement is consistent with both the Amended draft West Dapto Section 94 Development Contribution Plan and draft Wollongong Development Control Plan – Chapter D16 West Dapto Release Area.

Exhibition period: 1 November to 29 November, 2010.

Prior to Council determining whether to enter into a Planning Agreement, Council is seeking community comment.  If you have any comments it would be appreciated if they could be forwarded to Council by the 29 November 2010.  For convenience please quote file no. ESP-100.05.008.

Any such request will be dealt with in accordance with the Privacy and Personal Information Protection Act 1998.

You may also make an anonymous submission however if you choose to do so Council will be unable to contact you any further as to the outcome of your submission. It should also be noted that the lack of information as to your place of living may affect Council's consideration of the potential impact of the subject proposal.

Note: If Council receives a submission from any person who is legally required to provide a disclosure of any reportable political donation and / or gift under section 147 of the Environmental Planning and Assessment Act 1979, Council is legally required to publicly disclose all relevant details of the reportable political donation or gift onto Council's website. This will include the name and residential address of the person who provided the political donation or gift onto Council's website for full viewing by the general public.
