Public Exhibition of Corrections to a number of Minor Anomalies within the Wollongong LEP 2009

The Wollongong Local Environmental Plan 2009 came into force on 26 February 2010. A few minor anomalies were found within the report requiring correction and certain provision required updating. These anomalies include correction to street address, spelling, definition of terminology updated and minor rezoning of two sites and amendment to the land use tables. 

These proposed amendments to the Wollongong Local Environmental Plan 2009 include:

  • Part of 5-9 Molloy Street, Bulli – rezone to B2, amend floor space ratio to 1.5:1 and remove the minimum lot size from the Minimum Lot Size Map.
  • Lot 107, DP 751299 Cliff Road, Wollongong – rezone to RE1 to reflect property boundaries, remove the floor space ratio from the Floor Space Ratio Map, remove the minimum lot size from the Minimum Lot Size Map and remove building height controls.
  • Amend the Land Use table by inserting home-based childcare as being permissible with development consent in the RU2, RU4, R1, R2, R3, R4, R5, B1, E3 and E4 zones.
  • Clause 4.1 Minimum Lot Size be amended to allow lots containing split zones to be subdivided along the minimum lot size boundary, or that any residual land be excluded from the minimum lot size requirements.
  • Clause 7.9 Development in Flight Paths be amended to reflect the Department of Planning current model clause “Airspace Operations”.
  • Schedule 1 Additional Use, item I to be amended by correcting the spelling of “Buttershaw” Drive to “Buttenshaw” Drive.
  • Schedule 5 Environmental Heritage be amended for the following sites:
    Commonwealth Bank building address be corrected to 31-33 Wentworth Street, Port Kembla. Delete “(adjacent to Tourist Information Bureau)” for the listing of the Norfolk Island Pine 93 Crown Street, Wollongong.

The draft planning proposal will be on exhibition until 24 June 2011.

In accordance with the Government Information (Public Access) Act 2009, your submission including any personal information such as your name and address, will be made available for public inspection and may be exhibited on Council’s website. You may request, in the form of a statutory declaration, that Council suppress the personal information in your submission from public inspection, if you consider that the personal safety of any person would be affected if the information was not suppressed. Any such request will be dealt with in accordance with the Privacy and Personal Information Protection Act 1998.

You may also make an anonymous submission however if you choose to do so Council will be unable to contact you any further as to the outcome of your submission. It should also be noted that the lack of information as to your place of living may affect Council's consideration of the potential impact of the subject proposal.

Note: If Council receives a submission from any person who is legally required to provide a disclosure of any reportable political donation and / or gift under section 147 of the Environmental Planning and Assessment Act 1979, Council is legally required to publicly disclose all relevant details of the reportable political donation or gift onto Council's website. This will include the name and residential address of the person who provided the political donation or gift onto Council's website for full viewing by the general public.
