Conditions of Entry

Everyone using our centres must follow the Conditions of Entry, along with Patron Behaviour and Terms and Conditions.

Conditions of Entry

  • Towels must be used throughout the centre.
  • Covered shoes and appropriate gym clothing must be worn at all times.
  • Operating hours for the centre may change at any time at the discretion of the centre management.
  • Program timetables may be altered by centre management from time to time in response to customer demand.
  • Instructing other users of the centre about fitness techniques is strictly prohibited.
  • Behaviour contrary to centre rules and hygiene requirements as determined by centre management are grounds for expulsion from the centre and denial of re-admission.
  • All equipment must be returned after use.
  • The centre reserves the right to alter or cancel classes / usage for the safety of centre patrons for any reason, including maintenance, severe weather conditions or emergencies.
  • Loss of your member key tag may incur a replacement fee.

Patron Behaviour and Terms and Conditions

Patron behaviour

  • You will pay:
    • the entrance fee;
    • any fees associated with activities not included in the entrance fee.
  • You must comply with:
    • the terms of all regulatory signs and notices;
    • all lawful directions from facility staff.
  • You must not:
    • harass, threaten or intimidate facility staff or other members of the public;
    • behave in a manner that would reasonably be regarded as offensive;
    • use facility equipment in a reckless or dangerous manner;
    • deliberately or recklessly cause damage to any facility
    • bring, use or distribute alcohol, cigarettes (including vapes and e-cigarettes) and illegal substances into any part of the facility.
  • You must not use cameras or filming equipment of any description within the facility.

Your health

  • Do not attend a facility if you are suffering from a contagious illness, disease or injury.
  • You must advise facility staff:
    • of any illness, injury or other factor that may prevent you from safely using equipment or participating in activities;
    • if you feel unwell while exercising or participating in other activities within the facility.
  • If requested by facility staff (or required by the terms of your membership) you must:
    • complete a pre-exercise questionnaire;
    • obtain a medical clearance certificate from your doctor prior to exercising or participating in activities within the facility.
  • You must take reasonable care when moving about within the facility or using facility equipment or services. If you are not sure how to use a piece of equipment, you must ask a staff member for assistance – do not ask other patrons.

Video and privacy notice

  • Council uses video monitoring within its facilities for safety and security purposes.
  • Council may collect, store and disclose your personal information in accordance with the Privacy and Personal Information Act 1998.

Refusal of entry and cancellation of membership

  • Council reserves the right to:
    • refuse you entry to the facility,
    • remove you from the facility, or
    • cancel your membership,

    if you fail to comply with these terms and conditions or, having been requested to comply with the terms and conditions, fail to do so.

  • If your membership is cancelled under clause 3.1, you remain liable to pay all membership fees incurred, a cancellation fee and any other outstanding fees due to Council. (Note: The terms of your membership prevail over these Patron Behaviour Terms and Conditions to the extent of any inconsistency.)

Exclusion of liability

  • Council accepts no responsibility for any damage to, or loss / theft of, your personal property or belongings.
  • Entry to this facility is at your own risk. You may suffer injuries including broken bones, soft tissue injuries, joint injuries or even death.
  • In consideration of the grant of membership (whether ongoing or casual) you agree, to the extent permitted by law:
    • to not hold Council liable for any actions, suits, proceedings, claims, demands, losses, damages, penalties, fines, costs or expenses however arising that you may have had but for this clause arising from or in connection with your attendance at, or utilisation of the equipment or services provided by, this facility; and
    • to indemnify Council in respect of all actions, suits, proceedings, claims, demands, losses, damages, penalties, fines, costs or expenses however arising that you may have had but for this clause arising from or in connection with your attendance at, or utilisation of the equipment or services provided by, this facility.
