Creative Wollongong Short Film Competition Terms and Conditions

Below are the terms and conditions for the Creative Wollongong Short Film Competition.

The Promoter of this competition is Wollongong City Council.

This competition is presented by Wollongong City Council in partnership with Screen Illawarra.

Who can enter

  • You must be at least 12 years of age to enter and if you are under 18 years you must have your parent / guardian’s permission to enter. Your parent / guardian must read and consent to these Terms & Conditions. Council will contact your parent / guardian before awarding any prize.
  • The Competition is only open to Australian citizens and permanent residents who live in the Wollongong or Shellharbour Local Government Areas. If you enter the Competition, you may need to provide Council with proof of your name and address.
  • You cannot enter the Competition if you work for Wollongong City Council or Shellharbour City Council, or if you are the spouse, partner, parent, sister, brother or child (whether biological, step or adoptive) of someone who works for Council.
  • If you do not follow these terms and conditions, Council may disqualify you.  Failure by Council to enforce any of its rights at any stage does not constitute a waiver of those rights.

How to register

  • Registrations are open now and will close at midnight (AEDT) on 31 July 2024 (‘Registration Period’). Any registrations received outside the Registration Period will not be accepted.
  • Registrations can only be made through the website of Wollongong City Council and must include details of the film you are submitting. If you are part of a group, please only register once on behalf of the group (not a separate registration for each group member).
  • You must let Council know if any of your details change after you have registered. Requests to access or modify any information provided as part of the registration process should be directed to culturaldevelopment@wollongong.nsw.gov.au
  • There is no cost to enter the competition however internet connection and usage rates may apply.  Council is not and will not be liable for any costs you incur to enter the competition from the service provider.
  • You can submit as many films as you like.

The awards

  • The judges will select winners in each category after 31 July 2024 at Wollongong City Council’s Administration Building located at 41 Burelli Street, Wollongong NSW 2500.
  • If there is any event that prevents or hinders Council’s conduct of the Competition or Council's ability to deliver the prize/s to the prize winner/s of the Competition, Council may, in its discretion, cancel the Competition and recommence it at another time under the same conditions or select another winner.
  • The Winners will be announced on the Creative Wollongong Facebook page and, at Council’s discretion, on its social media channels.  Council will notify the Winners by email and / or telephone after the Short Film Festival in September 2024 (‘the Notification’).
  • Council’s decision in relation to any aspect of the Competition is final and binding and Council will not enter into any correspondence regarding the result, including in the event of a dispute.

The Prize

  • The Winners must contact Council within 7 days of the Notification to claim the Prize and make arrangements to collect it (‘the Claim Period’).  The Prize must be taken as stated, and is not transferable, exchangeable or redeemable for cash.
  • The Winners (if under the age of 18, their parent or guardian) may be required to verify their identity and residency status at the time of collecting the Prize.
  • Any ancillary costs associated with redeeming the Prize are not included. Redemption of the Prize is subject to any terms and conditions of the issuer including those specified on the voucher.
  • If the Prize is not collected from Council within the Collection Period, Council reserves the right to offer the Prize to a substitute Winner selected in accordance with these Terms and Conditions.
  • Once the Prize has left Council’s Administration Building, Council takes no responsibility for the Prize being damaged, lost or stolen.

Requirements for film entries

  • Your film must:
    • Be no more than 15 minutes long
    • Only include original material created by you, including (where applicable) any words, art, music, photographs, sound recordings or footage;
    • Either be filmed in a location with a natural water source (lake, river, creek, ocean, etc) within the Wollongong or Shellharbour Local Government Areas, or, include some footage of such a location. Water does not have to be central to the story, but it must appear at some stage during the film.
  • If anyone under the age of 18 years appears in your film, you must:
    • obtain written consent from the child’s parent(s) or guardian(s) for the child to be filmed and for your film to be shared on Council’s media platforms including Council’s website; and
    • provide copies of such written consent at the time of submitting your film.

General

  • Council may cancel or vary the Competition at any time. Council will not be responsible for any loss or costs you may incur in relation to such cancellation or variation.
  • By registering for the Competition, you release Council from, and indemnify Council against, all liability (including negligence) for any loss or damage or injury whatsoever which is suffered by  (including, but not limited to, indirect or consequential loss), or for any personal injury suffered or sustained in connection with the competition, or the use of the Prize, except for any liability which cannot be excluded by law.
  • By submitting your film to Council, you grant to Council a perpetual, royalty-free, non-exclusive, worldwide licence to broadcast, modify, reproduce or otherwise use your film for Council-related purposes (including the ability to sub-licence a third party engaged to carry out work or services on Council’s behalf).  You agree that Council is not liable for any costs, expenses, liabilities, losses or damages you incur or suffer as a result of Council exercising its rights under this licence.
  • You agree that Council can screen your film as part of Council’s ‘Best of…’ short-film event to be held on a date to be confirmed.
  • You are responsible for ensuring that your film does not infringe the intellectual property rights of any third party.
  • You will indemnify Council against:
    • all claims made against Council by any person in respect of any infringement of intellectual property rights contained in your film or Council’s use of your film; and
    • any costs (including legal costs on a solicitor and own client basis), losses or damages suffered or incurred by Council arising out of or in any way in connection with any claim referred to in the above.

Privacy Protection Notice

  • Purpose of collection: When you register for the Competition, Council will collect your personal information in order to verify your eligibility to participate.
  • Intended recipients: Council staff.
  • Supply: While the supply of personal information is voluntary, the information provided will enable your participation in the competition.
  • Access / Correction: Your personal information may be accessed by you and Council. A request to access, update or correct any information should be directed to Wollongong City Council.
  • Storage: The personal information collected will be stored by Council for the purposes indicated above. However, any personal information may be disclosed as required by law.
